Looked After Children (Scotland) Regulations 2009

These regulations support the Children (Scotland) Act 1995 and the Adoption and Children (Scotland) Act 2007. They are built on 3 core principles:  

  • the child’s welfare must come first 
  • the child’s views should be taken into account 
  • decisions should be made without delay and with the least intrusion into the child’s life

The 2009 Regulations bring together the regulation of care planning services with care provision for those children separated from their birth parents.

The 2009 Regulations outline the requirements when children are looked after by kinship carers.
