Children (Equal Protection from Assault) (Scotland) Act 2019
The Act ends the physical punishment of children by removing the old common law defence of “reasonable chastisement.”
This means that anyone charged with assaulting a child can no longer argue that the force used was justified as parental discipline or as part of caring for the child. As a result, children receive the same legal protection from assault as adults.
